UP-COMING REGULATIONS UPON STREAMING SERVICE PROVIDERS IN VIETNAM
In the National Assembly’s session of Vietnam dated 10 November 2020, some Vietnamese State’s agencies suggested that the regulations upon streaming service providers (“SSP”) need to be updated.
Accordingly, Minister of Information and Communications informed that the business operation of SSP (such as Netflix, Disney Plus, Apple TV, etc.) has gained a significant amount of revenue from Vietnam. As a result, they must bear tax responsibility for operation under the regulations on cross-border service same as local SSP.
In order to create a fair competitive market, the Government shall update the laws on tax, content editing and licenses. Now, the local SSP must follows the regulations on such matters. For example, they must obtain required licensed to proceed the streaming as well as get through the evaluation of contents. In the future, the foreign SSP might get approval from competent authority before streaming process due to this change. The new laws shall be applicable to foreign SSP upon their streaming service. This act shall protect not only local providers but also the benefit of State during the service’s performance.
Thus, the foreign SSP might satisfy some conditions of the Vietnamese laws for their services soon.
