Amid the digital transformation now taking place in Vietnam, the Law on Digital technology Industry No. 71/2025/QH15 (“Law on DTI”), which will take effect on 01 January 2026, is expected to create a solid legal corridor for the sustainable development of the digital technology industry.
In this article, BLawyers Vietnam summarizes the notable points of the Law on DTI such as the concept of digital technology industry activities; key digital technology products and services; and incentives in digital technology activities in concentrated digital technology parks.
1. Digital technology industry activities
Digital technology industry activities under the Law on DTI include the production of digital technology products and the provision of digital technology services.
Accordingly, the production of digital technology products is the implementation of one or more tasks of research and development, design, assembly, manufacturing, testing, inspection of digital technology products and other tasks to produce digital technology products.
Additionally, the provision of digital technology services is the performance of one or more following activities: consulting, design, installation, integration, management, operation, training, digitization, data processing, warranty, maintenance, repair, renovation, publication, distribution of digital technology products; providing digital technology products as services and other digital technology services.
2. Key digital technology products, services
According to the Law on DTI, key digital technology products and services are digital technology products and services that meet one of the following criteria:
- The domestic market has great demand and creates high added value;
- The world market has demand and has export potential;
- Implements key tasks of national digital transformation;
- Has positive and breakthrough impacts on technological innovation and economic efficiency of industries and fields.
Correspondingly, the Minister of Science and Technology issued the List of key digital technology products and services in each period in accordance with the management requirements of the industry and fields. Accordingly, enterprises need to consider referring to the above list to determine whether or not the types of products and services provided by the enterprise are key digital technology products and services.
3. Prioritizing the essential, shared digital industrial infrastructure
Pursuant to the Law on DTI, the State will prioritize allocating budget resources to invest in building essential, shared digital technology industrial infrastructure, including the following infrastructure:
- Facilities for research, design, and trial production of digital technology products and services;
- National shared key laboratory for digital technology;
- Facility for measuring, testing, and evaluating digital technology products and services;
- Data center;
- Concentrated digital technology park; and
- Other essential, shared digital technology industrial infrastructure.
4. Incentives for activities in concentrated digital technology parks
4.1. Concentrated digital technology parks
A concentrated digital technology park is a completely new concept, first stipulated in the Law on DTI. Accordingly, a concentrated digital technology park is a functional area, focusing on research and development activities (also known as R&D area), supporting, training, promoting innovation, incubating digital technology and digital technology enterprises, producing and trading digital technology products and services, providing infrastructure, and providing services to organizations, businesses, individuals and other activities in the field.
Consequently, the Law on DTI has stipulated several incentives for enterprises carrying out investment activities and digital technology industry activities in concentrated digital technology parks, to promote the development of this key industry.
4.2. Specific incentives
As presented in the above Item 3.1, the Law on DTI has specific incentives for concentrated digital technology parks as follows:
- Concentrated digital technology parks are subject to investment incentive policies for areas with particularly difficult socio-economic conditions according to the provisions of the law on investment and other relevant laws;
- Investment projects on construction and business of infrastructure of concentrated digital technology parks, and investment projects in the field of digital technology industry in concentrated digital technology parks are subject to investment incentive policies for industries and professions with special investment incentives according to the provisions of the law on investment and other relevant laws;
- Investment projects on construction and business of infrastructure of concentrated digital technology parks and investment projects in the field of digital technology industry using land in concentrated digital technology parks are exempted from or have reduced land rent according to the provisions of the law on land and other relevant laws;
- Investors implementing investment projects to build and operate infrastructure of concentrated digital technology parks may receive State support:
- Investing in technical infrastructure systems within the park and infrastructure connecting to the park including roads, electricity, clean water, water supply, drainage, collection and treatment of wastewater, solid waste and other works;
- Organizing a public passenger transport system to the concentrated digital technology park.
- Investment projects in the construction of housing, service works, and public utilities for workers working in concentrated digital technology parks shall enjoy incentives according to the provisions of the law on housing; real estate business and other relevant laws.
5. Suggested actions for technology enterprises
With the above-mentioned key points of the Digital Technology Industry Law 2025, technology enterprises should consider the following:
- Enterprises providing digital services should review their product list to determine whether or not they are in the key group, thereby effectively using support policies.
- If enterprises plan to invest in a concentrated digital technology park, they need to prepare documents to enjoy investment incentives and land rent exemptions.
