Vietnam: 03 notes on the conditions for issuing a pharmaceutical practice certificate to a foreigner or Vietnamese residing overseas in charge of pharmaceutical expertise

Pursuant to Law on Pharmacy 2016, a person in charge of pharmaceutical expertise (“PIPE”) at a distribution facility must have a pharmaceutical practice certificate. If the PIPE at a distribution facility is a foreigner or Vietnamese residing in overseas, what conditions must be considered?

In this article, BLawyers Vietnam highlights 03 key points regarding this issue.

1. Note 1: Conditions for qualification certificates

Qualification certificates issued by foreign training institutions must be recognized according to the regulations of the Minister of Education and Training of Vietnam. Accordingly, the PIPE must carry out a procedure under Circular No. 13/2021/TT-BGDDT to be granted a Certificate of Degree Recognition, ensuring that a dossier for issuing Vietnam pharmaceutical practice certificate is provided.

2. Note 2: Criteria for languages used in pharmacy practice

Regarding the criteria for languages used in pharmacy practice, Circular No. 07/2018/TT-BYT clearly states 02 cases about language conditions in pharmacy practice, including those who are recognized as fluent in the Vietnamese language; and those who are not recognized as fluent in the Vietnamese language:

  1. For a foreigner or Vietnamese residing overseas who is not fluent in the Vietnamese language for pharmacy practice, the certification for pharmacy practice shall have a statement saying that an “interpreter is required during practice”. The interpreter must meet the evaluation criteria to achieve a level of proficiency that is required to practice pharmacy and be granted a Certificate of pharmacy for a practicing interpreter.
  2. Foreigners and Vietnamese residing overseas who meet the language requirements for practicing pharmacy will be granted a Certificate of fluency in the Vietnamese language or other languages used in practicing pharmacy, ensuring that documentation for issuing a pharmaceutical practice certificate for foreigners and Vietnamese residing overseas is provided.
3. Note 3: Dossier for issuing a pharmacy practice certificate for foreigners and Vietnamese residing overseas through the review method

Dossier for issuing a pharmacy practicing certificate for foreigners and Vietnamese residing in overseas through reviewing method including these following documents:

  1. The application form for the Pharmacy practicing certificate;
  2. A certified true copy of the applicant’s qualification with a certified true copy Certificate of Degree Recognition for the overseas qualifications;
  3. The original copy or certified true copy of the certificate of practicing. If the practice was taken place in more than one facility, the practice duration will be the total duration of practice at the facilities according to the certificates of practice issued by such facilities.

If the scope of practice covered by the pharmacy practicing certificate applied for requires different practice durations and facilities, the application shall be enclosed with a certificate of practice of one or several facilities that meet requirements of each position. If the scope of practice covered by the pharmacy practicing certificate applied for requires the same practice durations and facilities, the certificate of practice is not required.

Note: Documents issued by overseas competent authorities must be legalized and enclosed with notarized Vietnamese translations pursuant to Vietnamese laws.
